By accessing our website or engaging our services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. These terms constitute a legally binding agreement between you ("Client," "you") and Global Profit Advisors LLC ("GPA," "we," "us").
GPA provides done-for-you outbound marketing services including SMS campaign management, cold calling, cold email, and data procurement. Our services include campaign strategy, infrastructure management, message deployment, compliance scrubbing, response filtering, and lead delivery as described in your service agreement.
As a client of GPA, you agree to:
GPA takes reasonable steps to minimize compliance risk, including TCPA litigator scrubbing, DNC list filtering, A2P/10DLC registration, and mobile number verification. However, GPA does not provide legal advice and makes no guarantee that campaigns are fully compliant with all applicable laws. Outbound SMS and calling campaigns carry inherent regulatory risk. You acknowledge and accept this risk by engaging our services. We strongly recommend consulting with a qualified attorney regarding compliance obligations specific to your business and jurisdiction.
All plans are billed monthly unless you have opted for quarterly prepayment. Payment is due at the beginning of each billing cycle. Failure to make timely payments may result in service suspension. Quarterly prepayment discounts (10%) are non-refundable once the billing cycle has begun.
All plans are month-to-month with no long-term contracts. You may cancel at any time by providing written notice before your next billing cycle. Cancellation takes effect at the end of the current paid period. No refunds are provided for partial months. Quarterly prepayments are non-refundable but service will continue through the end of the prepaid period.
GPA offers a 75+ positive response guarantee on Growth, Scale, and Enterprise plans. If your campaign does not generate at least 75 positive responses within the first 30 days, GPA will continue campaign operations at no additional charge until the 75-response threshold is met. This guarantee is subject to the following conditions:
All campaign copy, templates, strategies, and proprietary systems developed by GPA remain the intellectual property of GPA. Clients may not replicate, redistribute, or reverse-engineer GPA's sending infrastructure, campaign methodologies, or proprietary processes.
Program Description: Global Profit Advisors (a DBA of Kairos International Distributions LLC) may send SMS messages to contacts who submit their phone number through our website forms or booking system. Message types include: appointment confirmations, scheduling reminders, follow-up communications regarding service inquiries, account updates, and responses to inbound requests. Messages are service-related and informational in nature.
Message Frequency: Message frequency varies based on your interactions with our services. You may receive up to 5 messages per month unless you engage in active communication with our team, in which case frequency may increase during those conversations.
Opt-Out Instructions: You may opt out of receiving SMS messages at any time by replying STOP to any message you receive from us. Upon receiving your STOP request, we will confirm your removal and no further messages will be sent. You may also contact us at [email protected] to request removal.

Message & Data Rates: Standard message and data rates from your mobile carrier may apply to messages sent and received. Global Profit Advisors is not responsible for any charges from your carrier.
Carrier Liability Disclaimer: Global Profit Advisors and mobile carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission by your mobile carrier.
Age Restriction: Our SMS program is intended for users aged 18 and older. By opting in to receive SMS messages, you confirm that you are at least 18 years of age. If you are under 18, please do not submit your phone number through our forms.

By engaging GPA's outbound messaging services, you represent and warrant that all campaigns conducted on your behalf are intended for legitimate business communication purposes. You acknowledge that compliance with the Telephone Consumer Protection Act (TCPA), state telemarketing laws, and carrier acceptable use policies is a shared responsibility between GPA and the client.
GPA maintains compliance infrastructure including DNC registry scrubbing, TCPA litigator database filtering, mobile number verification, A2P/10DLC registration, and opt-out management. Clients are responsible for ensuring that their outreach objectives, target audiences, and business practices comply with all applicable federal, state, and local regulations. GPA strongly recommends that all clients consult with qualified legal counsel regarding their specific compliance obligations before initiating campaigns.
All campaigns include mandatory opt-out mechanisms. Any recipient who requests removal is permanently added to suppression lists and will not be contacted in future campaigns. GPA maintains detailed records of all campaign activity, opt-out requests, and compliance measures for audit purposes.
GPA provides campaign deployment and management services on an "as-is" basis. We do not guarantee specific results, deal closings, or revenue outcomes. Our liability is limited to the fees paid for the specific service period in question. GPA is not liable for any indirect, incidental, consequential, or punitive damages arising from the use of our services, including but not limited to lost profits, lost deals, regulatory fines, or legal claims resulting from outbound campaigns.
You agree to indemnify, defend, and hold harmless GPA, its officers, employees, and agents from any claims, damages, losses, liabilities, or expenses arising from your use of our services, your violation of these terms, or your violation of any applicable law or regulation.
Client-provided data remains the property of the client. Data procured by GPA on behalf of a client is licensed to the client for their use. GPA retains no ownership rights over client-provided data. Campaign performance data and analytics generated by GPA may be retained by GPA in aggregate, anonymized form for internal improvement purposes.
GPA reserves the right to modify these Terms of Service at any time. Changes will be posted on this page with an updated revision date. Continued use of our services after modifications constitutes acceptance of the updated terms.
These Terms of Service are governed by the laws of the State of Illinois, without regard to conflict of law principles. Any disputes arising from these terms shall be resolved in the courts of the State of Illinois.
